AI training obligation under the EU AI Act: what businesses in Austria must do now

Since 2 February 2025, businesses that use AI must ensure sufficient AI literacy among their people. A certificate is not required, but evidence is.

What the obligation requires

Article 4 of the AI Regulation (VO (EU) 2024/1689) obliges providers and deployers of AI systems to take measures so that their staff have a sufficient level of AI literacy. Technical knowledge, experience, education and the context in which the AI is used all count.

The obligation has applied since 2 February 2025. According to the EU Commission, the national market surveillance authorities will begin supervision and enforcement from August 2026.

Does this also affect us if we only use ChatGPT?

Yes. Anyone who uses AI tools in the business is a deployer within the meaning of the regulation. The EU Commission explicitly mentions employees who use ChatGPT: they should, for example, be aware of the risk of invented answers (“hallucinations”).

Is a certificate needed?

No. The EU Commission states: a certificate is not necessary; organisations can keep internal records of training and other measures. There is no mandatory course and no minimum number of hours. What matters is that the measures fit role and use and can be documented.

  • It practises with real tasks from the business: emails, quotes, research.
  • It covers data protection, professional secrecy and copyright in daily work.
  • It is repeated when new tools or tasks are added.
